Sugarland's attorneys have said that the band is not responsible for the August 13 stage collapse at the Indiana State Fair.
In response to various lawsuits filed against the band following the incident, James H. Milstone, the band's lawyer, argued in the court documents that Sugarland did not commission, design, or build the stage, and should not be liable.
"The incident at issue in this litigation resulted from a gust of wind of unprecedented intensity which caused a structure that may have been improperly designed, maintained and/or inspected to fail. As such, this was a true accident or act of God."
The attorney also suggested that those who were harmed "failed to exercise due care for their own safety" and "knowingly and voluntarily assumed and/or incurred the risk of injury to themselves."
