Battery Charge Against 'Desperate Housewives' Creator Marc Cherry Dropped

A battery charge has been dropped from a wrongful dismissal case pressed against "Desperate Housewives" creator Marc Cherry by the show's former star Nicollette Sheridan. The actress/model has claimed that Cherry assaulted her during an off-set meeting about a scene for the show.

The news was handed down by Judge Elizabeth Allen White and Cherry spoke with thewrap.com noting that he was thrilled with the decision:

"Obviously I am thrilled by the judges decision, but I am going to withhold further commentary until this matter is resolved completely," he explained.

Cherry still faces charges of firing Sheridan for lodging a complaint with ABC after the alleged assault. The trial has also had additional testimony from the show's construction coordinator Michael Reinhart, who claimed to have received an email indicating that ABC may have attempted to cover up the true cause of Sheridan's firing.
