Sugarland Must Testify In Indiana, Judge Rules

Jennifer Nettles and Kristian Bush of Sugarland have been ordered by a judge to testify in Indiana next month regarding the stage collapse at the Indiana State Fair last summer.

Marion Superior Court Judge Theodore Sosin ruled that Nettles and Bush must appear between April 1 and April 15.

A rep for the group said that "Sugarland is aware of the judge's ruling and of course plans to cooperate."

Seven died and many more were injured when winds knocked over the stage apparatus before Sugarland's performance.

In response to various lawsuits filed against the band following the incident, James H. Milstone, the band's lawyer, argued in the court documents that Sugarland did not commission, design, or build the stage, and should not be liable.

"The incident at issue in this litigation resulted from a gust of wind of unprecedented intensity which caused a structure that may have been improperly designed, maintained and/or inspected to fail. As such, this was a true accident or act of God."
