CBS has been denied a bid to prevent ABC from airing its new series "The Glass House." A Los Angeles judge determined that CBS' suit lacked merit.
CBS argues that the show is a "Big Brother" rip-off. However, the judge said that ABC had the most to lose from the restraining order as it would cost the network its investment, the jobs of the crew and the contestants' time and effort.
The judge noted that production techniques, which the two shows share, are not forms of intellectual property:
"I don't know that 'Glass House' will have any impact on 'Big Brother'. 'Big Brother' will go forward."
CBS, in a statement issued last week, says it "fully intend[s] to proceed with our claims against Disney/ABC for copyright infringement and misappropriation of trade secrets over 'The Glass House'."
"The Glass House" premieres Monday, June 18.
