Swisher Hygiene Inc. (SWSH: Quote, SWI.TO), a provider of essential hygiene and sanitation products and services, announced the resignation of Steven Berrard as President and Chief Executive Officer, effective immediately.
Swisher Hygiene also announced that on August 15, 2012 it received a letter from NASDAQ indicating that it is not in compliance with the filing requirements for continued listing under NASDAQ Listing Rule 5250(c)(1) since its Form 10-Q for the quarter ended June 30, 2012 will not be timely filed as a result of the company's continuing work on matters resulting from the previously disclosed audit committee investigation and procedures performed by the company's external auditors.
"In order to facilitate completion of the 2011 audit process, and in order to better focus my energies on the strategic direction of Swisher Hygiene, I believe it is in the best interest of the company and its shareholders for me to step down as President and Chief Executive Officer," said Berrard. He will continue as a member of the Board.
The company's Board appointed Thomas Byrne, Swisher Hygiene's current Executive Vice President, as Interim President and Chief Executive Officer, effective immediately.
