Wednesday, specialty pharmaceutical company Watson Pharmaceuticals, Inc. (WPI:
News ), said that its subsidiary Watson Laboratories, Inc. - Florida has filed an Abbreviated New Drug Application or ANDA, with the U.S. Food and Drug Administration, or FDA, to market trospium chloride extended-release 60 mg capsules before the expiration of a patent owned by Supernus Pharmaceuticals, Inc.
The Corona, California-based company noted that trospium chloride extended-release capsules are the generic version of Allergan Inc.'s Sanctura XR product indicated for the treatment of overactive bladder with symptoms of urge urinary incontinence, urgency and urinary frequency, which had total U.S. sales of nearly $42 million for the 12 months ended March 31.
Earlier on July 13, 2009, Allergan had filed a suit under the provisions of the Hatch Waxman Act against Watson Pharma in the U.S. District Court for the District of Delaware seeking to prevent Watson from commercializing its products prior to expiration of U.S. Patent. The suit had resulted in a stay of final FDA approval of Watson's ANDA for up to 30 months or until final resolution of the matter before the court, whichever occurs sooner.
WPI closed Tuesday's trading at $33.50 on the NYSE.
