Wednesday, Edwards Lifesciences Corp. (EW) said the Court of Appeals for the Federal Circuit affirmed a previous court decision in favor of Cook Inc. and W. L. Gore & Associates that the companies did not infringe Edwards' patents for modular or multi-part endovascular grafts for treatment of abdominal aortic aneurysms.
While Edwards expressed disappointment over the court's ruling, it said that the ruling does not impact any of its businesses because the company discontinued its AAA product line in April 2006. Another co-defendant in this case settled with Edwards in January 2006 under terms including a payment of $37.5 million.
Earlier, in March, Edwards won a patent violation case against Cook in Germany. The court established that Edwards Lifesciences did not breach on Cook's German transcatheter valve patent. Edwards Lifesciences' countersuit claiming invalidity of Cooks' German patent is expected to be heard in Munich in 2010.
The company had a separate lawsuit against Cook in the United Kingdom, challenging the validity of Cook's UK transcatheter valve patent.
EW closed Wednesday's regular trading at $67.35 down $0.36 or 0.53% on a volume of 0.315 million shars on the NYSE.
