A New York State Court of Appeals heard arguments this week from New York City health officials requesting they reconsider Mayor Bloomberg's proposed ban on large sized sugary drinks.
Manhattan-based State Supreme Court Justice Milton A. Tingling threw out the ruling in March, claiming the regulations were arbitrary and overstepped the New York Board of Health's authority.
The Board of Health's legal team faced stiff questioning from a group of appellate judges, noting the lack of proposed regulation on other unhealthy foods like ice cream, milk shakes and red meat. A lawyer representing the soda industry faced far more welcoming treatment at the hearing, according to the New York Times.
"The justices were doing what they are supposed to do, which is to be very skeptical and to probe the weaknesses of the arguments on either side, and I think the city's lawyers responded very effectively," Dr. Thomas A. Farley, the city's health commissioner, told the Times after the hearing.
