Despite reports to the contrary on Monday, it seems that IRS official Lois Lerner will not testify before the House Oversight and Government Reform Committee, instead invoking her rights under the fifth amendment.
Lerner was the IRS official who first notified congress about the targeting of conservative groups.
"She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course," Lerner's attorney, William Taylor, said in a letter to the committee.
The committee was hoping to question her not only about the targeting but also about the revelation that the targeting came to light because of a planted question at a recent tax conference.
The head of the American Center for Law and Justice says a lawsuit will be filed soon on behalf of many of the groups that had been targeted by the IRS.
