A Florida man has reportedly been sentenced to 71 days in prison plus restitution payments after stealing a $3.25 ice cream sundae. Tobias Franklin, 20, of Orange County, Florida pleaded guilty to the incident, which occurred in March.
The Orlando Sentinel reports that Franklin allegedly ordered the treat and then bolted from the store, located at Orange Blossom Trail near Church Street in Orange County. The owner of the shop initially followed Franklin on foot before going back to the shop and following him in a car until police arrived.
He was charged with burglary by snatching and resisting merchandise recovery, both of which a third degree felonies. The seemingly harsh sentence comes largely due to Franklin's previous record, including a 2011 arrest for burglary of a conveyance and petty theft, the Sentinel reports.
