Man Charged After Drunken Assault At Restaurant

A heavily-intoxicated man was arrested at a Broken Arrow restaurant for assault late Sunday night.

Wayne A. Herl, 49, was taken to Tulsa Jail early Monday on two complaints of assault with a dangerous weapon, first offense driving under the influence and speeding.

According to reports, Herl had been swinging a broom and struck two people at the Waffle House located at 2210 N. Aspen Avenue in Broken Arrow.

As officers were responding to the call, they spotted Herl driving southbound on Aspen Avenue in excess of the speed limit. He initially ignored police signals to stop before finally halting on a curb a half-mile down the road.

He registered a blood alcohol content of .27, which is three times the legal limit. Herl is being held on $21,100 bond.
