Ferrero Settles Lawsuit Over Marketing For Nutella

Candy maker Ferrero has settled a class action lawsuit for allegedly leading consumers to believe their chocolate/hazelnut spread Nutella is a health food. News of the settlement broke on Thursday, April 26 and the company will reportedly pay out over $3 million.

Word of the lawsuit initially came out last year when a mother filed claims against Ferrero stating that their advertising falsely implied that Nutella is healthy. One ad in particular was cited in the case, in which a woman explains how she feeds Nutella to her family.

"In Nutella's marketing and advertising, Defendant omits that the nutritional value claimed, if any, is not derived from Nutella, but is instead derived from other foods or drinks (e.g., whole grain breads, fruit and milk) which are advertised to be consumed along with Nutella," reads the lawsuit.

"Defendant's claims regarding Nutella are also false and misleading because they omit that Nutella contains over 55% processed sugar, the consumption of which has been shown to cause type 2 diabetes and other serious health problems," the suit adds.

Consumers having purchased the product between January 1, 2008 and February 3, 2012 can now file a claim to receive a portion of the settlement.
