Massey Unit Receives Imminent Danger Order Under Section 107(a) Of Mine Act

Massey Energy Co. (MEE) disclosed in a regulatory filing that Marfork Coal Company, its subsidiary and the operator of the Horse Creek Eagle Mine, received an imminent danger order on November 23, 2010 under section 107(a) of the Federal Mine Safety and Health Act of 1977.

The order stated that the mine roof in one of the entries to the mine fell blocking access to two evaluation points and that the mine roof in another entry to the same area was severely deteriorated.

Massey stated that it is currently evaluating the situation and will take steps to correct any unfavorable conditions and ensure the safety of its miners.

The Richmond, Virginia-based Massey, which faced public controversy and safety concerns after a tragic explosion at its Upper Big Branch Mine in southern West Virginia in April, noted that no injuries resulted from the condition described in the order.
