Wednesday, weight-management services provider Weight Watchers International, Inc. (WTW) said that the court granted it temporary restraining order in its lawsuit against Jenny Craig, Inc. prohibiting Jenny Craig from broadcasting, publishing or disseminating claims of superiority over the Weight Watchers program, finding that such claims are not supportable.
The New-York based Weight Watchers on January 19 filed a complaint in the U.S. District Court for the Southern District of New York for injunctive relief and damages against Jenny Craig stating that the advertising campaign brought out by the company is not supported by fact or science.
Weight Watchers said that Jenny Craig is currently running an advertising campaign that seeks to mislead and deceive consumers into believing that its claims are based on a head-to-head scientific study comparing Weight Watchers current weight-loss program and Jenny Craig's pre-packaged meals system. The ads mislead consumers into believing such a trial has taken place.
The complaint states that to support Jenny Craig's claims, the generally accepted standards of biomedical research require Jenny Craig to compare the two current offerings of both companies through a head-to-head randomized clinical trial. However, Jenny Craig chose to make a purported scientific claim by twisting the findings of an irrelevant 10-year-old Weight Watchers study against a new Jenny Craig study.
The company noted that neither of the two studies cited by Jenny Craig compares the efficacy or success of Jenny Craig to Weight Watchers. The lawsuit also explains in detail that the study used by Jenny Craig to deceive consumers is now in its fourth generation program. Each generation of the Weight Watchers program has allowed the company to incorporate the latest science and make its program more flexible and livable so it can translate into real world results for consumers.
WTW closed Wednesday's regular trading session at $29.09, up $0.07 or 0.24% on a volume of 0.48 million shares on the NYSE.
