The Lanier Law Firm said that it has won a $54.2 million verdict against Caterpillar Inc. (CAT) and Holt Texas Ltd. after a jury finding that defects and lax maintenance led to a construction worker being paralyzed while using a piece of Caterpillar equipment.
The Law Firm represented Alfonso Lopez, 38, and his family in claims that Caterpillar failed to inform Lopez about defects in the company's 623 G Wheel Tractor Scraper. Holt Texas faced claims that the company failed to perform proper maintenance on the machinery.
During the 12-day trial, jurors were asked to award damages based on the defective design, manufacturing and marketing of the Caterpillar 623 G Wheel Tractor Scraper, and damages from Holt Cat of Texas for negligently maintaining the scraper.
Jurors assessed 90% of the actual damages against Caterpillar and 10% against Holt Texas.
