Rohm & Haas Co. (ROH) Tuesday said that the Court of Chancery of the State of Delaware granted Rohm and Haas's request for expedited proceedings in the case of Rohm and Haas Co. v. The Dow Chemical Co. (DOW). The trial on Rohm and Haas's complaint for an order requiring Dow to close its merger with Rohm and Haas is now scheduled to commence on March 9, 2009, in Georgetown, Delaware, and is scheduled to be concluded that week. Rohm and Haas filed its action on January 26, 2009, with the Court of Chancery of the State of Delaware to enforce the merger agreement with Dow entered on July 10, 2008.
Under the merger agreement, Dow is required to close the transaction within two business days of receiving all regulatory approvals. The last of the required regulatory approvals to close the deal was received from the U.S. Federal Trade Commission on January 23, 2009.
