Barr Pharma Challenges Azur Pharma's Patent Suit On FazaClo 25mg, 100mg

Generic drug maker Barr Pharmaceuticals Inc. (BRL) Monday said its subsidiary Barr Laboratories has initiated a challenge of Ireland-based Azur Pharma's patent suit with regard to Barr's Abbreviated New Drug Application for the 25 mg and 100mg doses of FazaClo, an orally disintegrating tablet formulation of clozapine.

Montvale, New Jersey-based Barr dismissed Azur's patent claims and asserted that it was the first to file an Abbreviated New Drug Application for FazaClo, which had annual sales of about $34 million in the U.S.

Last week, Azur, together with Cima Labs, filed a patent lawsuit in the Delaware district court seeking a ban on the commercialization of FazaClo.

FazaClo is approved for the treatment of advanced-stage schizophrenic patients who fail to respond to standard treatments. The drug is also indicated for reducing the risk of recurrent suicidal behavior in patients with schizophrenia or schizoaffective disorders.

BRL is currently trading at $67.03, down $0.32 or 0.48%, on a volume of about 204 thousand shares.
