Smith & Nephew's (SNN,SN.L) Advanced Wound Management division said Tuesday that the UK Court of Appeal has ruled in favor of the company in a patent litigation with Kinetic Concepts Inc. (KCI).
The Court determined that the KCI patent covering the use of foam dressing kits with Negative Pressure Wound Therapy systems is not valid and lifted a previously issued injunction against Smith & Nephew.
Earlier, a Patents Court ruled that 7 out 10 claims asserted were invalid but the remaining 3 had been infringed by Smith & Nephew's Renasys-F dressing. Smith & Nephew subsequently appealed the decision in the UK Appellate Court and won the litigation.
Kinetic Concepts expressed its disappointment over the Court's decision, and said it plans to appeal the decision to the House of Lords. The company added that the ruling is limited to the UK patent at issue and does not directly affect the other patents in KCI's portfolio or any other proceedings outside the UK.
SNN is currently trading at $35.93, down 13 cents. SN.L closed Tuesday's regular trading session at 438.75 pence, down 3.50 pence. KCI is currently trading at $25.44, down 25 cents.
