Gainers:

Bank of America Corp. (BAC) is rising 1 percent to $15.35. The company agreed to pay $335 million as settlement for charges related to alleged discriminatory lending practices by its subsidiary Countrywide Financial.

WCA Waste Corp. (WCAA) is jumping 30 percent to $6.39 as the company agreed to be acquired by Macquarie Infrastructure Partners II or MIP II, a North American infrastructure investment fund. The transaction is valued at about $526 million.

Yahoo! Inc. (YHOO) is rising nearly 2 percent to $16.30. The company is reportedly considering cutting its 40 percent stake in Alibaba Group Holding Ltd. to about 15 percent.

Curis Inc. (CRIS) is up nearly 8 percent to $4.68 based on the news that its collaborator Roche has submitted a Marketing Authorization Application for vismodegib to the European Medicines Agency. Curis has earned a $6 million milestone payment from Genentech as a result of the MAA submission to the EMA.

Decliners:

American Greetings Corp. (AM) is down 10 percent to $15.35. The company's third quarter profit declined from previous year.

Bed Bath & Beyond Inc. (BBBY) is falling over 4 percent to $58.70. The company's third quarter profit and sales improved from the year-ago quarter. Sales were below consensus. The company's comparable store sales grew 4.1 percent, compared to a 7 percent increase prior year.

VIVUS Inc. (VVUS) is falling more than 14 percent to $8.89. The company announced preliminary results from its retrospective study of medical claims data on oral clefts associated with topiramate exposure in utero.
