Cephalon, Inc., (CEPH) in a filing with the regulatory, disclosed that it has filed a lawsuit in U.S. District Court in Delaware, on December 8, 2009, against Actavis Group, Actavis Pharma Manufacturing Pvt. Ltd. and Actavis Inc. for infringement of patents for NUVIGIL armodafinil Tablets.
Cephalon specified that it filed the lawsuit based upon an Abbreviated New Drug Application filed by Actavis seeking approval from the U.S. Food and Drug Administration for a generic equivalent of armodafinil to be sold in the United States.
